Welcome to the website of Austin Dental Plus (“we,” “us,” “our,” or “ADP”). These Terms & Conditions (“Terms”) govern your access to and use of https://austindentalplusny.com (the “Site”), any subdomains, mobile versions, and any related services (collectively, the “Services”). By using or accessing the Site / Services, you agree to be bound by these Terms (as may be amended from time to time) and by our Privacy Policy (which is incorporated herein by reference). If you do not accept these Terms, you should not use or access the Site.

1. Collection and Use of Personal Information

Request an appointment through our website, by phone, or in person
Submit information through our Contact Us form
Sign up for updates, promotions, or newsletters
Leave comments on our blog posts
Communicate with us in any other way regarding our dental services

Schedule, confirm, and manage appointments
Communicate with you regarding services, treatment updates, or inquiries

Non-Sharing Commitment:
We do not sell, rent, or share your contact information with third parties or affiliates for marketing or promotional purposes. Any sharing of data is solely for operational or compliance purposes (e.g., insurance verification, payment processing, hosting).

2. Mobile Messaging Policy

By providing your mobile phone number, you may consent to receive appointment reminders, service updates, and other communications via SMS.
Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
If you wish to stop receiving messages, you can opt out at any time by texting STOP. Message and data rates may apply depending on your carrier.

3. Use of the Site & Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) or have parental or guardian consent to use the Site / Services.
You agree not to misuse the Site or interfere with its security, functionality, or other users. Prohibited conduct includes attempting unauthorized access, scraping, uploading malicious code, or misrepresenting your identity.

4. Appointments, Treatment & Financial Responsibility

4.1 Appointments & Cancellations

Appointments must be booked in advance. Missed appointments or late cancellations may result in fees.

We require a courtesy of a 24 hour hour cancellation.
Patient must confirm appointment in order to secure the appointment time.
Unconfirmed appointments, same day appointments and walk-ins are not guaranteed.

4.2 Treatment & Consent

All treatments are provided by licensed dental professionals. You will be informed of risks, benefits, alternatives, and costs before consenting to treatment.

4.3 Payment & Insurance

Payment is required for services rendered, regardless of insurance coverage.
At this time, Austin Dental Plus only accepts PPO plans and private pay.
We do have no interest financing options available upon request. ADP currently accepts major credit cards, FSA/HSA cards, and financing options, but these options are subject to change.
We accept many dental insurance plans (Aetna, Anthem BCBS, Cigna, Delta Dental, Guardian, MetLife, Principal, Solstice, SunLife, United Healthcare PPO, Ameritus). Coverage varies, and you are responsible for confirming benefits and paying any uncovered amounts.

5. Intellectual Property

All site content, including text, graphics, logos, and images, belongs to ADP or its licensors and may not be copied, distributed, or used without permission.

6. Links to Third-Party Sites

External links are provided for convenience only. ADP is not responsible for third-party sites, their content, or their policies.

7. Disclaimers & Limitations of Liability

Site content is informational only and not a substitute for professional dental advice.
The Site and Services are provided “as is.” ADP disclaims all warranties to the fullest extent permitted by law.
ADP shall not be liable for indirect or consequential damages. Liability, if any, is limited to the amount paid for the relevant services.

8. Indemnification

You agree to indemnify and hold harmless ADP and its affiliates from any claims arising from your use of the Site, violation of these Terms, or infringement of third-party rights.

9. Termination

ADP may suspend or terminate your access to the Site or Services at any time. Upon termination, your right to use the Site ceases immediately.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York. You consent to the jurisdiction of the courts in Queens County, NY, for all disputes.

11. Severability & Waiver

If any provision of these Terms is held invalid, the remaining provisions remain enforceable. Failure to enforce a right or provision is not a waiver. New patients must sign standard HIPA policy document with our front desk, which is a protection of your records and private information.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ADP regarding the Site and Services.
